  • We reserve the right to limit quantities, refuse orders, discontinue products, or correct pricing or typographical errors at any time, even after an order has been submitted or confirmed.
  • Prices are listed in the currency displayed on the Services and do not include applicable taxes, duties, or shipping charges unless stated otherwise.
  • Kavelys operates using a direct-fulfillment (dropshipping) model; product availability and shipping timelines are dependent in part on third-party suppliers and may vary.

5. Orders and Acceptance

Your placement of an order constitutes an offer to purchase. All orders are subject to acceptance and verification by Kavelys, and we reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or unavailability of product, whether or not the order has been confirmed or payment processed. In the event of a cancellation after payment, you will receive a full refund of amounts charged.

6. Payment

By providing payment information, you represent and warrant that you are authorized to use the designated payment method. Payment is processed through third-party payment processors, and your use of such payment methods is subject to their respective terms. Kavelys does not store your full payment card information.

7. No Medical or Health Claims

They are not designed, intended, or approved to diagnose, treat, cure, or prevent any disease or medical condition. Nothing on the Services constitutes medical advice. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. Your interactions with any third party are solely between you and that third party.

11. Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH EXCLUSION IS PROHIBITED BY APPLICABLE LAW. KAVELYS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KAVELYS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY. IN ALL CASES, KAVELYS' TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Kavelys and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

14. Force Majeure

Kavelys shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, labor disputes, supplier delays, or disruptions to shipping and logistics networks.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation by contacting us at the details below. If a dispute cannot be resolved informally, both parties agree that the courts of the Province of Ontario shall have exclusive jurisdiction, except where applicable consumer protection law grants you the right to bring a claim in your local jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and Kavelys regarding the Services and supersede any prior agreements.
